Binance Faces MiCA Scrutiny as Lagarde Weighs ECB Exit Before October 2027

Binance is still serving some European customers, three months after the July 1 deadline for unlicensed firms to begin winding down. Its explanation rests on a MiCA exemption that EU crypto regulators are now examining. Across Europe’s financial institutions, another date is drawing attention. Christine Lagarde’s departure from the ECB. She has left room for an early exit, though Binance’s immediate problem comes down to how its customers arrived.

Binance MiCA Exemption Faces a Closer Look

Recent reports revealed that ESMA and regulators in France, Germany and Greece are questioning Binance’s reliance on reverse solicitation. The exchange says it complies with applicable regulations and is pursuing MiCA authorization.

The exemption permits a firm outside the EU to serve a European customer who independently requests its services. What matters is how that relationship started. A customer finding the exchange without prompting is different from one responding to its advertising.

Article 61 of MiCA covers that distinction explicitly. Promotion or solicitation, including through someone acting on a firm’s behalf, can prevent the provider from relying on the exemption. Signing a disclaimer does not change the underlying facts.

There is another restriction. An independently initiated relationship does not give the firm permission to market new categories of crypto assets or services to that customer. This makes the Binance license question more complicated than whether Europeans can still log in. Regulators must examine which services are being provided and whether the customer genuinely requested them without solicitation.

The enquiries reported so far have not established a breach. Any enforcement action would depend on the authorities’ assessment of Binance’s explanation and activities.

Christine Lagarde Says She Will Remain Into 2027

Lagarde has offered a narrower answer to speculation about her future. In a statement published by the ECB on September 30, she said she might leave a few months before her term ends in October 2027. She had announced nothing specific. She also dismissed the prospect of running for France’s presidency. She added,

“One thing is certain: I will still be here in 2027.”

Lagarde’s name had already surfaced in the Binance license dispute. Reports revealed that a senior Greek regulatory official told Binance she had intervened to block its application. Greece’s regulator denied the remarks attributed to its officials and said it reviewed the application independently. Crypto exchange licenses are approved by national regulators, with no formal role for the ECB.

October 2027 remains the scheduled end of her term. Binance’s timetable is less clear. Pursuing authorization leaves unresolved whether the exemption covers the European business it continues to conduct.
